In this book, Flynn develops a philosophical approach to human rights that is continuous with and a reflection on the intercultural dialogue on human rights. Some of the most heated debates about human rights over the last few decades have focused on whether they are compatible with non-Western traditions such as "Asian Values" or Islam. Flynn draws on Jurgen Habermas s discourse theory to develop a philosophical account of human rights that connects with the ongoing intercultural dialogue on human rights while also being attuned to the global spread of modern institutions. He also engages with the strongest alternatives to this approach: the "political conceptions" of human rights developed by John Rawls and his followers, as well as the idea of constructing an "overlapping consensus" through dialogue, which takes its most convincing form in Charles Taylor s work. He defends a discourse theory of human rights as a compelling and much-needed middle path between these practical approaches and more traditional approaches to deriving human rights from a single source.

Industry Reviews

"An exciting new contribution to the literature on human rights. Flynn systematically reconstructs Habermas's discourse-theoretical approach to human rights and compellingly argues for its superiority over rival approaches." -- Amy Allen, Dartmouth College, USA

"Jeffrey Flynn's important new book is aimed at the central issues raised as actors around the globe grapple with the apparent tension between the universal aspirations of human rights and our manifest differences...[It] is a model work of political philosophy: careful and clear in its argument, rich in detail, and ambitious in scope...Flynn is very thorough and charitable toward his interlocutors. Certainly, one cannot find a better critical exposition of Habermas on human rights and global dialogue." -- Stephen C. Angle, Wesleyan University, USA, Notre Dame Philosophical Reviews
